New Law Shields Georgia Physicians from Liability

April 14, 2013

Georgia’s new law protects physicians who fail to follow administrative guidelines related to federal quality of care and payment reform measures, such as the Affordable Care Act. The legislation, expected to be signed by Gov Deal by the end of this month, will prevent evidence of any breaches in federal guidelines from reaching the courtroom. It will also prevent the use of compliance as evidence that the standard of care was met. Bill proponents hope the law will replicated in other states.
